All deliveries and services provided by us are subject to the following General Terms and Conditions in the version valid at the time of your order.

Shopping in the 0bis3 baby shop online

Shopping at www.0bis3.de is only possible for customers who have a delivery address in Germany.

Consumers within the meaning of Section 13 of the German Civil Code (BGB) and these General Terms and Conditions are natural persons with whom we enter into business relationships without this being predominantly attributable to their commercial or independent professional activity.

Individual contractual agreements take precedence over these General Terms and Conditions. Differing, conflicting, or supplementary General Terms and Conditions shall not become part of the contract unless their validity is expressly agreed upon.

§ 2 Offer in the online shop and conclusion of contract
2.1
The product presentations in the online shop serve as a purchase offer on your part and merely constitute an invitation to place an order. You place an order with us by placing items in the shopping cart, entering your delivery and payment details, providing your email address so that we can inform you by email about your right of return and send you the contract text, confirming the accuracy of your information in the control overview, and finally clicking the "Buy now" button. By clicking the "Buy now" button, you submit a binding purchase offer. Our products are sold only for private use in normal household quantities.

We can accept your order by sending order confirmations by email or by delivering the goods within 2 days of receiving your order. Confirmation of receipt of the order does not constitute acceptance of the purchase offer. If the consumer orders the goods electronically, we will confirm receipt of the order immediately. The confirmation of receipt lists the details of the order. It does not constitute a binding acceptance of the order, but is only intended to inform you that we have received the order. However, it can be combined with a declaration of acceptance. You will receive all customer information from us no later than the time the goods are delivered, which you should print out for your records. You agree that you may also receive your invoices electronically (as a PDF by email) from us.

2.3
Should our order confirmation contain any typographical or printing errors, or should the presentation and determination of product prices be based on technical transmission errors, we reserve the right to contest the order. In doing so, we must prove our error to you. Any payments already made by you will be refunded immediately.

2.4
The consumer must be at least 18 years old to order goods from us. In case of doubt, the consumer must provide proof of age. The necessity of providing age arises from the payment methods we use.

2.5
Even repeated goodwill services by us shall not constitute a claim for the future.

§ 3 Reservations and Collection
3.1
In addition to delivery, 0bis3 Babyshop also offers in-store pickup for online orders upon prior reservation. This means you can have your selected items ready for pickup at our store, provided they are in stock. To use this option, it is important that you select the "Pickup" option in our online shop before placing the order in your shopping cart. Subsequent changes are not possible.

3.2
Once you have placed the goods in your shopping cart as pickup items, complete the process in our shopping cart by clicking on "Complete reservation." You will receive a reservation notification from us. This reservation notification is for your information only and has no impact on the conclusion of the contract. After receiving your reservation request, we will then check whether your reservation request has been fulfilled. You will only receive a pickup notification from us when the goods are in stock at our store and your reservation request can be fulfilled. With the pickup notification, the store offers you a binding contract for the goods you have reserved. By picking up the goods from the selected store, you accept the store's offer.

3.3
Upon presentation of the pickup notification, you can collect the goods our store on the following business day or at the time you specify. If you do not collect the goods on the following business day or at the time you specify, the binding offer to conclude the contract will expire.

3.4
Payment is made on-site (please note that store pick up orders requires cash payment) If we offer PayPal as a payment option, you can pay the invoice amount in advance via PayPal. Redeeming a voucher with PayPal payments is not possible. Subsequent settlement or crediting of the voucher upon collection is not possible. When paying via PayPal, the PayPal General Terms and Conditions (https://www.paypalobjects.com/webstatic/de_DE/ua/pdf/ua.pdf) also apply.

§ 4 Prices
The prices listed on the product pages of the online shop www.0bis3.de include VAT and other price components. For online orders, the prices quoted at final checkout are subject to applicable shipping costs. Depending on the option selected, the price quoted applies to purchases in the 0bis3 BabyOne online shop or for collection in our store. Therefore, the price quoted for purchases made using the "Reserve and Collect" option in the 0bis3 Babyshop store may differ from the price quoted for purchases made in the online shop.

§ 5 Shipping Costs
5.1

While most of our products are offered with free shipping, certain orders or some orders may by offered with shipping cost. For furniture shipping via a freight forwarding company, we charge a flat rate of €75.00 per order with a 0bis3 Babyshop Card and €119.00 without an 0bis3 Babyshop Card. There is no free shipping limit.

5.2 Non-Free Shipping Articles
For parcel delivery within Germany with DHL, we charge a flat rate of €19.99 per order for postage and packaging eg for Strollers on offer, baby beds on offer etc. Some others may cost lower. For particularly bulky items, we charge a surcharge of up to €6.99 per bulky item in addition to the shipping costs. The relevant information and the amount of the surcharge can be found in the respective item description.

5.3
No further taxes or costs shall apply.

5.4
Upon the updating website, all previous prices and other information about goods become invalid. The information at the time you order the goods shall prevail.

§ 6 Delivery Conditions and Reservation of Self-Supply
6.1
Delivery is only possible within Germany. Deliveries are made via DHL. Further information regarding delivery can be found in sections 6.3 and 6.4 of the General Terms and Conditions.

6.2
If we do not have all of the products ordered in stock, we are entitled to make partial deliveries of products at our own expense, provided this is reasonable for you.

6.3
If the shipment is being handled by a freight forwarder, the freight forwarder will contact you to arrange a delivery date. For this purpose, we ask you to provide a telephone number.

6.4
If the parcel is being shipped, DHL may make up to two delivery attempts at your request. If the courier cannot reach you personally, they will leave the parcel in your mailbox if possible or, if available, at a designated drop-off location. If the product and service combination allows it, a substitute delivery will be made to your neighbor. Otherwise, the parcel will be delivered to a Packstation/branch office, and you will be notified accordingly.

6.5
If the ordered product is unavailable because it is economically impossible for us to procure it for you through no fault of our own, we reserve the right to withdraw from a concluded purchase contract. In this case, we will notify you immediately. We will reimburse you for any consideration you have already provided.

§ 7 Payment Terms
7.1
Payments can be made via the online shop either by credit card (Mastercard and VISA), direct bank transfer, PayPal, or purchase on account. Payments by credit card (Mastercard and VISA), direct bank transfer and PayPal

7.2
From the date of default, you shall additionally pay interest on the invoice amounts invoiced by us at a rate of five percentage points above the base interest rate.

7.4
When paying by credit card, the amount will be reserved on your credit card when you place your order (so-called authorization). Your credit card will actually be charged when we ship the goods to you. In the event of a return, we will credit the amount back to your credit card account as soon as possible after your return checked and processed in our logistics center.

By choosing Sofortüberweisung as your payment method, you can pay conveniently, easily, and securely without registering. All you need is your online account details. You can then easily pay using your bank code, account number, PIN, and TAN. More information is available at https://www.sofort.de .

7.6
You can also pay for your goods order using PayPal. To do so, you will need a valid PayPal account, which you can open at www.paypal.com . If you select this payment method, you will need to enter your email address and password into the PayPal input mask displayed at the end of the order process. The payment amount due for the order, including any shipping costs, will be credited to our account immediately. Shipping will occur after PayPal has confirmed payment. Please note that if you select PayPal as your payment method, the "PayPal Terms of Use" of PayPal (Europe) S.à rl & Cie, SCA apply. The terms of use that apply to your contractual relationship with PayPal (Europe) S.à rl & Cie, SCA can be found at www.paypal.com .

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you purchase on account as a payment option. The payment period is 14 days from dispatch of the goods/ticket/or, in the case of other services, the provision of the service. Payment is made to Klarna. Please note that purchase on account is only available to consumers and that the use of this payment method requires a positive credit check. The complete terms and conditions for purchase on account for deliveries to Germany can be found here . Klarna checks and evaluates your data and, where there is a legitimate interest and reason, exchanges data with other companies and credit agencies. Your personal data will be treated in accordance with applicable data protection regulations and in accordance with the information in Klarna's privacy policy.

§ 8 Vouchers (Gift Cards and Digital Vouchers)
The issuer or issuer of the voucher is the operator of the respective store or online shop where you purchased the voucher. The voucher can only be redeemed for goods related to babies/toddlers up to the age of 4. The voucher cannot be redeemed for other goods. The voucher is valid for three years from the end of the year in which you purchased the voucher. Cash refunds are excluded.

§ 9 Right of Withdrawal for Consumers

Consumers have a right of withdrawal of 14 days. Consumers within the meaning of the German Civil Code (BGB) and these Terms and Conditions are natural persons with whom we enter into business relationships without this being predominantly attributable to a commercial or self-employed professional activity.

Cancellation policy

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the last partial shipment or the last item.

by means of a clear statement (eg, a letter sent by post, fax, or email) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of cancellation
If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; Under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods to us or hand them over in our store immediately and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.

We will not bear the cost for no-reason returns. If it is expressly clear that the goods were erroneously fulfilled by us eg wrong colour, wrong goods etc., you will receive a free return label from us. Please return only to the return address specified by us as we have various fulfillment warehouses.
Please take note that even in the lattter case where we are liable for the return cost, you will be liable for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary to check their quality, properties, and functioning.

End of the cancellation policy

Note on non-existence of the right of withdrawal:

The right of withdrawal does not apply to distance contracts for the delivery of goods which are liable to deteriorate quickly or whose expiry date would be quickly exceeded, or to distance contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

9.2
You must use appropriate packaging to prevent damage and contamination of the ordered products that may occur during return shipment. If possible, return the goods to us in their original packaging, including all accessories and packaging components. If necessary, use protective outer packaging in individual cases. If you no longer have the original packaging, please ensure adequate protection against transport damage by using packaging suitable for the respective product to avoid claims for damages against you for damage caused by inadequate packaging.

9.3
When purchasing hygiene products (eg, mattresses, breast pumps, pacifiers, diapers, etc.), please note that due to their nature, these products require particular care. Therefore, if you notice after receiving the goods that you wish to exercise your right of withdrawal, we ask you not to use the goods in question. The statutory exclusion of the right of withdrawal for certain categories of goods remains unaffected.

9.4
Please note that the modalities for exercising the right of withdrawal set out in paragraphs 8.2, 8.3 and 8.4 above are not a prerequisite for the effective exercise of the right of withdrawal in distance contracts.


§ 10 Agreement on the exercise of the right of withdrawal by consumers by returning
Goods Consumers within the meaning of Section 13 of the German Civil Code (BGB) and Section 1.4 of these General Terms and Conditions have the option of exercising their right of withdrawal for distance selling contracts by returning the goods. In order to effectively and timely exercise the right of withdrawal within the 14-day withdrawal period in accordance with the withdrawal policy, the consumer is obliged to expressly mark the goods upon return so that the return by 0bis3 Babyshop can be recognized as a withdrawal. If several goods that can be sent by parcel are returned to us within one return shipment, the consumer must clearly indicate which of the returned goods is to be covered by the exercise of the right of withdrawal for distance selling contracts.

if the goods that can be sent by parcel are not marked when multiple goods are returned, or if the return is not marked or designated as a cancellation, the right of cancellation by returning the goods is not effective and has not been exercised in a timely manner, subject to any other cancellation options used by the consumer.

§ 11 Transport damage
11.1
If goods are delivered with immediately recognizable and therefore obvious transport damage, please report such defects to the deliverer immediately and contact us as soon as possible:

Failure to file a complaint or contact us in the event of transport damage will not affect your statutory warranty rights or their validity. However, your actions will help us assert our own legal claims against the carrier or any existing transport insurance.

§ 12 Warranty and No-reason 14-day right of return
12.1
The statutory warranty provisions apply.

12.2
We grant our customers a 14-day right of return. This right of return begins upon receipt of the goods, regardless of the chosen shipping method. This first 14 day period is covered by the statutory right of withdrawal. This right of return expires once 14 days have passed since receipt of the goods. The no-reason returns are no longer possible after this point.

§ 13 Liability
13.1
We are only liable for intent and gross negligence. To the extent that an attributable breach of duty is based on simple negligence and a material contractual obligation (obligations whose fulfillment is essential for the proper execution of the contract, whose breach jeopardizes the achievement of the contract's purpose, and on whose compliance you as a customer regularly rely) is culpably violated, our liability for damages is limited to the foreseeable damage that typically occurs in comparable cases. In the event of injury to life, body, or health, we are liable in accordance with the statutory provisions.

13.2
Liability under the provisions of the Product Liability Act remains unaffected. Otherwise, liability is excluded.

§ 14 Final Provisions
14.1
Should any provision of these General Terms and Conditions be invalid, the remaining provisions of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.

14.2
The conclusion and performance of all contracts shall be governed by German law. However, this applies to you as a consumer only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which you have your habitual residence.

14.3
The provisions of the UN Convention on Contracts for the International Sale of Goods shall expressly not apply.

§ 15 Notice on the Consumer Dispute Resolution Act (VSBG)
15.1
Notice requirement under the Consumer Dispute Resolution Act (VSBG): 0bis3 Babyshop declares in advance that it is not willing to participate in dispute resolution proceedings before consumer arbitration boards within the meaning of Section 36 (1) of the Consumer Dispute Resolution Act (VSBG). This does not affect the possibility of dispute resolution by a consumer arbitration board during or in the course of a specific dispute, with the consent of both parties (Section 37 VSBG).

C. Information obligations for contracts in electronic commerce

1. Information on the conclusion of a contract
The contract between the seller and the buyer is concluded in accordance with Section 2 of the seller's General Terms and Conditions (GTC) (see above).

2. Information on reservation of non-delivery in case of unavailability
The seller reserves the right, in accordance with Section 5.4 of the seller's General Terms and Conditions (GTC), not to provide the promised service and thus the delivery of the goods in the event of their unavailability and to withdraw from the contract (see above).

3. Information about the technical steps that lead to the conclusion of a contract
The contract is concluded by offer and acceptance.

3.1 Order Process/Customer Offer Process
If the customer has found a product in the seller's offering that meets their requirements, they can place it in the shopping cart. If the customer wishes to view the shopping cart, they can do so at any time by clicking the "Shopping Cart" button. Products that the customer does not wish to order or no longer wishes to order can be changed or deleted at any time by clicking the "Change Item" button (to change the quantity of items) or "Delete Item" button (to remove the selected item from the shopping cart). After all desired items have been placed in the shopping cart, the customer must enter their data. The seller has appropriately marked the input fields in which the customer must enter their mandatory information for proper order processing. At the end, the customer can click the "Buy Now" button. By clicking the "Buy Now" button, the customer submits a binding offer to purchase.

3.2 Acceptance by the Seller
The acceptance of the Customer's offer is made by the Seller in accordance with Section 2.2 of the Seller's General Terms and Conditions (GTC) (see above).

4. Information on the storage of the contract text and customer access options.
The contract text is stored in the seller's shop system. The customer can always view the general terms and conditions (GTC) on this website. The details of each order and the GTC are automatically sent to the customer via email. After the customer has completed the order by registering, the data can be accessed in the user account. Orders placed without registration can no longer be viewed online after completion.

5. Information on technical means for detecting and correcting input errors.
Before completing the order, the customer can correct their details at any time. This applies to both the quantity of ordered items and the selected items themselves. To do so, the customer can change their details using the mouse or keyboard, removing items from the shopping cart, and increasing or decreasing the quantity of individual items to be ordered. In addition, all order details will be displayed again before completing the order, allowing the customer to make corrections.

6. Information on the language available for concluding the contract
Only the German language is available for concluding contracts.
